BUCKEYE, AZ — JASKO Enterprises, Inc. has filed a public comment with the Federal Motor Carrier Safety Administration in support of the proposed rule making failure to meet English-language proficiency requirements a federal out-of-service condition (Docket No. FMCSA-2026-0826).
In the comment, JASKO founder and President Jasmin Maljanovic states that English proficiency is a daily safety requirement for the refrigerated carrier — drivers must read grade, weight-restriction, and do-not-enter signs, respond to inspectors at roadside, and complete duty-status and inspection reports accurately — and that the evaluation is already the carrier’s duty under 49 CFR 391.11(b)(2), proven through driver qualification files.
The comment further asks FMCSA to publish a single, repeatable roadside ELP assessment protocol — what the officer asks, what counts as a pass — so carriers can align their hiring screens to the same standard and drivers know what is expected.
The comment was filed with FMCSA under Docket No. FMCSA-2026-0826.
